Introduction
These Terms and Conditions (“Agreement”) govern the relationship between Anagatas by PT. Anagata Arwana Indonesia is a (“Platform”) and the vendor (“Vendor”) who registers and lists their services such as hotels, tours, events, and related travel products on the Platform. By creating an account and listing your services, you agree to comply with the terms outlined below.
Account Registration and Maintenance
Eligibility:
Vendors must be at least 18 years old and legally authorized to operate their business in their jurisdiction.
Account Setup:
Vendors are required to provide accurate and up-to-date information during registration, including business name, contact information, and bank account details for payouts.
Account Security:
Vendors are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their account. Notify the Platform immediately of any unauthorized access.
Listings
Content Requirements:
Listings must be accurate, complete, and free from misleading information.
Images, descriptions, and pricing must reflect the actual product or service offered.
Vendors are prohibited from listing prohibited or illegal activities.
Compliance:
All services must comply with applicable laws, regulations, and industry standards.
Platform Moderation:
The Platform reserves the right to review, modify, or remove listings that violate these terms or harm the Platform’s reputation.
Payments and Commissions
Pricing:
Vendors are responsible for setting prices for their listings, which must include all applicable taxes and fees.
Commissions:
The Platform will deduct a 15% commission from the total price of each booking made through the Platform.
Payouts:
Payouts will be processed daily, weekly and monthly subject to a minimum payout threshold of US$ 100.
Vendors must provide valid banking details for payouts.
Cancellations and Refunds
Vendor Cancellation Policy:
Vendors must clearly outline their cancellation and refund policies in their listings.
Customer Refunds:
The Platform may process refunds in accordance with the Vendor’s policy or if the Vendor fails to deliver the promised service.
Platform Intervention:
In disputes, the Platform reserves the right to mediate and, if necessary, issue refunds to customers, deducting the amount from the Vendor’s future payouts.
Vendor Responsibilities
Service Delivery:
Vendors are responsible for delivering services as described in their listings and ensuring customer satisfaction.
Customer Communication:
Vendors must promptly respond to customer inquiries and resolve any complaints professionally.
Indemnification:
Vendors agree to indemnify and hold the Platform harmless from any claims, damages, or liabilities arising from their listings or services.
Prohibited Activities
Vendors must not:
Post false or misleading information.
Engage in fraudulent activities.
Use the Platform for purposes other than listing and managing their services.
Solicit bookings outside the Platform to avoid commissions.
Intellectual Property
The Platform retains all rights to its website, branding, and software. Vendors may only use the Platform’s branding as permitted for marketing their listings.
Termination
Vendor Termination:
Vendors may terminate their account at any time by providing written notice to the Platform.
Platform Termination:
The Platform reserves the right to suspend or terminate a Vendor’s account for violating these terms or engaging in unlawful activities.
Post-Termination Obligations:
Listings will be removed, and outstanding payouts will be processed in accordance with this Agreement.
Liability
The Platform is not liable for disputes between Vendors and customers or for any damages arising from the use of the Platform. Vendors agree to bear full responsibility for their listings and services.
Amendments
The Platform reserves the right to update these terms with prior notice. Vendors are encouraged to review this Agreement periodically. Continued use of the Platform constitutes acceptance of the updated terms.
Governing Law
This Agreement shall be governed by the laws of Indonesia.
