Welcome to the Anagatas websites and mobile applications available at www.anagatas.com and corresponding country-specific top-level domains (including their associated sub-domains), related software programs (often called "apps"), data, SMS, APIs, email, chat and phone communication, buttons, widgets, and advertisements (together, all these items will be referred to as the "Services"; in a broader sense, the Anagatas websites and mobile properties will hereinafter be referred to as "websites").
The Services are offered by PT. Anagata Arwana Indonesia, a limited liability company registered in Delaware and located in Gianyar, Bali, Indonesia ("Anagatas") at our official address of [Jl. Pasekan no.100x, Batubulan Kangin, Sukawati, Gianyar]. The terms "we," "us," and "our" will be interpreted accordingly. By establishing an Anagatas account, you accept the terms, conditions, and notices outlined below (referred to collectively as this "Agreement"). This Agreement does not apply if you only visit the websites or utilize the Services without creating an Anagatas account. Please review this Agreement thoroughly, as it contains details regarding your legal rights, restrictions on these rights, and information about applicable law and the resolution of disputes. If you are a consumer in the EU or UK, you have the legal right to withdraw from this Agreement within 14 days of its establishment. You can do this, or end this Agreement at any other time, by closing your account (by contacting us or through "Account Info" while logged in and choosing the "close account" option) and ceasing to access or use the Services.
As a consumer in the EU or UK, you are entitled to specific mandatory consumer rights. Consumers residing in other regions may also possess consumer rights as dictated by their local laws. This Agreement does not alter your mandatory consumer rights. Any materials you can view, access, or interact with through the Services, including information, text, links, graphics, photos, audio, videos, data, code, or other arrangements of materials, will be referred to as "Content." The "Services," as outlined previously, pertain to those offered by Anagatas or our corporate affiliates (collectively referred to as the "Anagatas Companies"). To clarify, all websites are owned and operated by Anagatas PT. Anagata Arwana Indonesia. Nonetheless, certain specific Services available through the websites may be owned and managed by Anagata's corporate affiliates, such as Services that assist with booking Tours, Hotels, Car Rental, Space, Event, Flight, Cruises, and Travel News with third-party providers (as explained below). As part of our Services, we might send you notifications about special promotions, products, or additional services that may interest you, available from us, our affiliates, or our partners. Such notifications are usually transmitted through newsletters and marketing communications, aiming to better understand you and your preferences across our Services and those of our affiliates. Consequently, this allows us to customize services according to your preferences. The terms "you" or "user" refer to the individual, company, business organization, or other legal entity that has created an Anagatas by PT. Anagata Arwana Indonesia account and utilizes the Services and/or contributes Content to them. The Content you contribute, submit, transmit, or post through the Services will be referred to collectively as "your Content," "Content of yours," and/or "Content you submit." The Services are offered continuously and exist to:
1. Help users gather travel information, share Content, and search for and reserve travel services; and
2. Support travel, tourism, and hospitality businesses in connecting with users and potential customers through free and/or paid services provided by or through the Anagatas Companies. Products, services, information, and Content within our Services are frequently updated to remain current (for instance, with the latest information and offers). This implies that new transportation services, accommodations, restaurants, tours, activities, or experiences may be added for your booking, while other services may no longer be available.
We may alter or otherwise amend this Agreement in the future as outlined in the terms and conditions specified herein, and you acknowledge and accept that your ongoing access to or utilization of the Services after such modifications indicates your agreement to the updated or amended Agreement. The date of the last revisions made to this Agreement will be documented at the bottom of this Agreement, and any changes will become effective upon being posted. We will inform you of significant changes to these terms and conditions either by sending a notification to the email address linked to your profile or by posting an announcement on our websites. Please remember to revisit this page periodically to examine the most up-to-date version of this Agreement. If you do not wish to accept any amendments to this Agreement, you have the option to terminate your account and stop using the Services (details on how to do this are available here).
USAGE OF THE SERVICES As a prerequisite for using the Services, you agree that
(I) all information you provide through the Services to the Anagatas Companies is truthful, accurate, up-to-date, and complete,
(ii) you will protect your account information and will oversee and be fully accountable for any use of your account by anyone other than yourself,
(iii) You are at least 13 years old. The Anagatas Companies do not intentionally collect information from individuals under the age of 13. If you are a consumer living in the EU or the UK, we may refuse you access to the Services if you breach this Agreement, or for any other valid reason. If you do not reside in the EU or the UK as a consumer, we reserve the right at our sole discretion to deny you access to the Services at any moment and for any reason, including but not limited to breaches of this Agreement. By utilizing the Services, including any products or services that enable the sharing of Content to or from third-party sites, you acknowledge that you are fully responsible for any information you share with the Anagatas by PT. Anagata Arwana Indonesia Companies. You may utilize the Services only as intended through the functionality provided and as allowed under this Agreement. Reproduction, transmission, duplication, sharing, or redistribution of
(a) Content or any part of it and/or
(b) The Services are more broadly expressly forbidden without prior written consent from the Anagatas Companies. To access specific features of the Services, you will need to set up an account. When establishing an account, you must provide accurate and complete information. You are entirely responsible for the activities taking place on your account, including your interactions and communications with others, and you need to protect your account. To support this, you agree to keep your contact information current. If you are creating an Anagatas account for business purposes and accepting this Agreement on behalf of a company, organization, or other legal entity, you confirm that you are authorized to do so and have the authority to bind that entity to this Agreement. In this case, the terms "you" and "your" in this Agreement will refer to that entity, while the individual acting on behalf of the company will be termed a "Business Representative." By using the Services, you may come across links to third-party sites and apps or have the ability to engage with such sites and apps. This could involve sharing Content from the Services, including your own Content, with third-party sites and apps. Please note that third-party sites and apps may publicly show any shared Content. These third parties might impose fees for the use of specific content or services available on or through their websites. Therefore, you should conduct any assessments you deem necessary before proceeding with transactions involving any third party to confirm whether fees will apply. When the Anagatas Companies provide information regarding fees or charges for third-party content or services, such details are intended for convenience and informational purposes only. Any engagement with third-party sites and apps is at your own risk. You explicitly acknowledge and agree that the Anagatas by PT. Anagata Arwana Indonesia Companies have no responsibility or liability concerning any such third-party sites or apps.
The Anagatas by PT. Anagata Arwana Indonesia Companies utilize recommender systems to rank and present listings to you. Various categories of listings, including hotels, restaurants, attractions, and flights, are prioritized based on distinct criteria like price, "traveler favorites," and duration. Comprehensive information regarding our ranking policies and criteria can be found on the How the Site Works webpage. Some of the content you encounter or access through our Services is intended for commercial use. You acknowledge and understand that the Anagatas by PT. Anagata Arwana Indonesia Companies may display advertisements and promotions on the Services in proximity to your Content, including video or other dynamic content, both before, during, or after its display, as well as alongside the Content of others.
ADDITIONAL PRODUCTS
Occasionally, the Anagatas by PT. Anagata Arwana Indonesia Companies may alter, update, or discontinue certain products and features of the Services. You acknowledge and understand that the Anagatas by PT. Anagata Arwana Indonesia Companies are not obligated to store or maintain your Content or other information you provide, except as mandated by applicable law. We also provide other services that may be subject to additional terms or agreements. If you engage with any of these services, the additional terms will be provided and will be incorporated into this Agreement, unless the additional terms explicitly exclude or replace this Agreement. For instance, if you utilize or purchase such additional services for commercial or business purposes, you must accept the relevant additional terms. In instances where other terms conflict with the conditions of this Agreement, the specific additional terms will take precedence regarding those services.
PROHIBITED ACTIVITIES
The content and information available on and through the Services (which includes, but is not limited to, messages, data, information, text, music, audio, images, graphics, video, maps, icons, software, code, or other material), along with the infrastructure utilized to provide such content and information, is owned by the Anagatas by PT. Anagata Arwana Indonesia Companies or licensed to them by third parties. For all content other than your own, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or resell any information, software, products, or services obtained from or through the Services. Furthermore, you agree not to:
(i) utilize the Services or Content for any commercial purpose outside the specific commercial purposes explicitly allowed under this Agreement and the associated guidelines provided by the Anagatas by PT. Anagata Arwana Indonesia Companies;
(ii) access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy, or otherwise exploit any content within the Services, including, but not limited to, user profiles and photos, using any robot, spider, scraper or other automated methods, or any manual process for purposes not permitted by this Agreement, or without our express written consent;
(iii) breach the restrictions in any robot exclusion headers on the Services or evade or bypass other methods used to restrict or limit access to the Services;
(iv) undertake any action that imposes, or could impose, in our sole judgment (or, if you are a consumer residing in the US, UK or EU, in our reasonable judgment), an unreasonable or disproportionately heavy load on our infrastructure;
(v) deep link to any part of the Services for any reason without our written permission;
(vi) "frame," "mirror," or otherwise incorporate any part of the Services into any other websites or services without prior written authorization from us;
(vii) attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software used by the Anagatas by PT. Anagata Arwana Indonesia Companies in relation to the Services;
(viii) bypass, disable, or otherwise tamper with security-related features of the Services or features that prevent or limit the use or duplication of any Content;
(ix) download any Content unless it has been explicitly made available for download by the Anagatas by PT. Anagata Arwana Indonesia Companies; or
(x) use, assist, encourage, or enable any third party to make use of any robot, spider, AI system, or other automated device, process, or means to access, retrieve, copy, scrape, aggregate, collect, download, or otherwise index any segment of the Services or any Content, unless expressly permitted by Anagatas by PT. Anagata Arwana Indonesia in writing.
PRIVACY POLICY AND DISCLOSURES
Any personal data you share on or submit in connection with the Services will be handled in accordance with our Privacy and Cookies Statement. Click here to view our Privacy and Cookies Statement.
REVIEWS, COMMENTS, AND USE OF OTHER INTERACTIVE AREAS; LICENSE GRANT. We value your feedback. Please note that by providing your Content to or through the Services, whether through email, posting via any Anagatas by PT. Anagata Arwana Indonesia synchronization product, or through the services and applications of other entities, including any of your Content sent to your Anagata by PT. Anagata Arwana Indonesia account via any Anagatas by PT. Anagata Arwana Indonesia Companies product or service, as well as reviews, questions, photographs or videos, comments, suggestions, ideas, or similar items in any of your Content—you grant the Anagatas by PT. Anagata Arwana Indonesia Companies a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to
(a) host, utilize, reproduce, modify, execute, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform such Content of yours globally in any media, whether currently existing or created in the future;
(b) Make your Content accessible to the global audience and allow others to do the same.
(c) to provide, promote, and enhance the Services and to make your Content shared on the Services available to other companies, organizations, or individuals for syndication, broadcasting, distribution, promotion, or publication on different media and services, in accordance with our Privacy Policy and this Agreement; and
(d) Use the name and/or trademark that you present in connection with such Content of yours. You recognize that Anagatas by PT. Anagata Arwana Indonesia may choose to give credit for your Content at our sole discretion (or, if you are a consumer located in the UK or EU, at our reasonable discretion).
Additionally, you grant the Anagatas by PT. Anagata Arwana Indonesia Companies has the authority to take legal action against any individual or entity that infringes upon your or the Anagatas by PT. Anagata Arwana Indonesia Companies' rights in your Content by violating this Agreement. You agree and acknowledge that your Content is not confidential or proprietary. You confirm that you own or possess the necessary licenses, rights (including copyright and other proprietary rights), consents, and permissions to publish and otherwise use (and for the Anagatas by PT. Anagata Arwana Indonesia Companies to publish and otherwise use) your Content as permitted under this Agreement.
If it is concluded that you maintain moral rights (which include rights of attribution or integrity) regarding your Content, you hereby assert that, to the maximum extent allowed by applicable law,
(a) You do not necessitate the use of any personally identifiable information in connection with the Content, or any derivative works or updates related to it;
(b) You have no objections to the publication, usage, modification, deletion, and exploitation of your Content by the Anagatas by PT. Anagata Arwana Indonesia Companies or their licensees, successors, and assigns;
(c) You permanently waive and agree not to assert any claims to any and all moral rights as an author in relation to your Content; and
(d) You forever release the Anagatas by PT. Anagata Arwana Indonesia Companies and their licensees, successors, and assigns from any claims you might otherwise bring against the Anagatas by PT. Anagata Arwana Indonesia Companies are based on such moral rights.
Please be aware that any feedback or other suggestions you provide might be used at any time, and we are not obligated to keep them confidential. The Services may include discussion forums, bulletin boards, review services, travel feeds, or other areas where you can share your Content, such as reviews of travel experiences, messages, materials, or other items ("Interactive Areas"). If Anagatas by PT. Anagata Arwana Indonesia offers such Interactive Areas on the websites; you are fully responsible for your usage of these areas and do so at your own risk. The Anagatas by PT. Anagata Arwana Indonesia Companies do not guarantee confidentiality for any of your Content you submit to the Services or in any Interactive Area. If any entity that is part of the Anagatas by PT. Anagata Arwana Indonesia Companies provides a private communication channel among users, You consent to such entity(ies) possibly monitoring the content of those communications to help maintain the safety of our community and the Services.
You acknowledge that the Anagatas by PT. Anagata Arwana Indonesia Companies do not edit or control user messages that are posted or distributed via the Services, including in chat rooms, bulletin boards, or other communication forums, and will not be liable or responsible for such messaging in any manner. In particular, Anagatas by PT. Anagata Arwana Indonesia does not edit or control users' Content displayed on the websites. Nevertheless, the Anagatas by PT. Anagata Arwana Indonesia Companies retain the right to remove and/or restrict without notice any such messaging or other Content from the Services if they believe in good faith that such Content violates this Agreement or consider the removal and/or restriction necessary to protect the rights of the Anagatas by PT. Anagata Arwana Indonesia Companies and/or other users of the Services.
If you disagree with the removal of your Content from the websites, you may appeal our decision through Anagatas by PT. Anagata Arwana Indonesia's internal complaint resolution process. Further information on how to contest and appeal a decision regarding the removal or restriction of your Content can be found here.
By using any Interactive Areas, you explicitly agree only to submit Content that adheres to Anagatas by PT. Anagata Arwana Indonesia published guidelines, which are in effect at the time of submission and available to you. You expressly agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the Services any of your Content that: Is false, illegal, misleading, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing (or promotes harassment of another individual), threatening, infringing on privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable;
Is clearly offensive to the online community, such as content that endorses racism, bigotry, hatred, or any form of physical harm against individuals or groups; Would involve, promote, encourage, or offer guidance for illegal activities, criminal offenses, lead to civil liability, infringe on the rights of any individual in any country, or create liability or violate any local, national, or international laws, including but not limited to the regulations set by the U.S. Securities and Exchange Commission (SEC) or any rules from securities exchanges such as the New York Stock Exchange (NYSE), NASDAQ, the London Stock Exchange, or the Indonesian Stock Exchange; Indonesia Law, Offers instructional content about illegal activities such as creating or purchasing unlawful weapons, invading another’s privacy, or producing or distributing computer viruses; Might infringe upon any patent, trademark, trade secret, copyright, or other intellectual or proprietary rights of another party. Specifically, this includes content promoting illegal or unauthorized copies of copyrighted works, such as sharing pirated software or links to it, providing information on how to bypass manufacturer-installed copy protection, or sharing pirated music or links to pirated music files; Includes mass mailings or constitutes "spamming," "junk mail," "chain letters," or "pyramid schemes"; Pretends to be another person or entity or otherwise falsifies your connection with any individual or organization, including the Anagatas by PT. Anagata Arwana Indonesia Companies; Contains private information belonging to a third party, such as addresses, phone numbers, email addresses, National Insurance numbers, bank account, and credit card details. Note that the surname (family name) of an individual may be shared on our websites only if explicit permission from the identified individual has been obtained in advance; Houses restricted or password-protected pages, or hidden pages or images not linked to or from any accessible page; Includes or is intended to disseminate viruses, corrupted data, or other harmful, disruptive, or destructive files; Is not relevant to the subject matter of the Interactive Area(s) where the content is posted; or In Anagatas by PT. Anagata Arwana Indonesia's sole discretion (or in our reasonable judgment if you are a user residing in the US, UK, or EU),
(a) breaches the prior provisions,
(b) contravenes Anagata's PT. Anagata Arwana Indonesia's associated guidelines that are provided to
you by Anagata by PT. Anagata Arwana Indonesia,
(c) is objectionable,
(d) restricts or inhibits others from using or enjoying the Interactive Areas or any other component of
the Services, or
(e) may subject any of the Anagatas by PT. Anagata Arwana Indonesia Companies or their users to any
form of harm or liability.
To the extent allowed by applicable law, the Anagatas by PT. Anagata Arwana Indonesia Companies disclaim any responsibility and accept no liability for any Content that you (in the case of your Content) or any third party (in the case of all Content generally) posts, stores, transmits, or uploads to the Services, nor for any resulting loss or damage, nor for any errors, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity you may come across.
As an interactive service provider, and to the extent allowed by applicable law, Anagatas by PT. Anagata Arwana Indonesia does not hold liability for any statements, representations, or other Content provided by its users (including your Content) on its websites or any other forums. Although Anagatas by PT. Anagata Arwana Indonesia is not required to screen, edit, or monitor any Content posted to or distributed through any Interactive Area, it retains the right and has complete discretion (or, if you are a consumer located in the US, UK or EU, in our reasonable judgment) to remove, screen, translate, or edit any Content posted or stored on the Services at any time and for any reason, or to delegate such actions to third parties. To the extent permitted by applicable law, you solely bear the responsibility for creating backup copies of and replacing any Content you submit or store on the Services at your own cost and expense. RESTRICTION AND/OR SUSPENSION OF YOUR USE OF THE SERVICES
Using the Interactive Areas or other components of the Services in violation of the above terms breaches this Agreement and may lead to consequences such as the termination or suspension of your rights to access the Interactive Areas and/or the Services in general. Anagatas by PT. Anagata Arwana Indonesia reserves the right to halt the processing of notices and complaints submitted through the Services if you often submit clearly unfounded notices or complaints. Our procedure regarding the suspension of your access to the platform is further outlined here.
Limiting Anagatas by PT. Anagata Arwana Indonesia License Rights. You have the option to restrict the Anagatas by PT. Anagata Arwana Indonesia Companies' use of your Content moving forward under this Agreement (as explained above) by choosing to grant the Anagatas by PT. Anagata Arwana Indonesia Companies has a more restricted license described further below (this more limited license will be referred to as a "Restricted License"). You can make this choice by selecting the Restricted License grant here (please note that you must be logged into your account to do so). If you decide to make this choice, the rights you provide to the Anagatas by PT. Anagata Arwana Indonesia Companies, regarding your Content according to the previously stated license terms (referred to as the "Standard License") will be limited in several key ways discussed in paragraphs 1 through 6 below; consequently, the Anagatas by PT. Anagata Arwana Indonesia Companies will not retain a Standard License for any of your Content other than the text-based reviews and associated bubble ratings you submit (for which the Anagatas by PT. Anagata Arwana Indonesia Companies will still be granted a Standard License), and will be given a "Restricted License" for the rest of your Content as defined below: When you upload your Content to the Services, the license you give the Anagatas by PT. Anagata Arwana Indonesia Companies for Your Content will be confined to a nonexclusive, royalty-free, transferable, sublicensable, and worldwide license to host, utilize, distribute, modify, execute, reproduce, display publicly, translate, and create derivative works from your Content for the purpose of showcasing it on the Services, as well as utilizing your name and/or trademark in association with that Content. Subject to Paragraph 6 below, the Restricted License applies to any of your Content (again, excluding text-based reviews and associated bubble ratings) that you or someone acting on your behalf (e.g., a third party managing your account) share on or in relation to the Services. For any specific item of your Content that falls under the Restricted License, you can terminate the Anagatas by PT. Anagata Arwana Indonesia Companies' licensing rights by deleting that post from the Services. Similarly, you can revoke the Anagatas by PT. Anagata Arwana Indonesia Companies' licensing rights for all of your Content covered by the Restricted License are forfeited by deleting your account (instructions for doing this can be found here). Regardless of any contrary statements, your Content
(a) will remain on the Services if you shared it with others who copied or stored it before you deleted it or terminated your account,
(b) may still be displayed on the Services for a reasonable duration after you delete it or terminate your account, while we work to remove it, and/or
(c) may be kept (but not displayed publicly) for technical, fraud moderation, regulatory, or legal reasons in backup form for a certain period of time.
RESTRICTION AND/OR SUSPENSION OF YOUR USE OF THE SERVICES
Using the Interactive Areas or other components of the Services in violation of the above terms breaches this Agreement and may lead to consequences such as the termination or suspension of your rights to access the Interactive Areas and/or the Services in general. Anagatas by PT. Anagata Arwana Indonesia reserves the right to halt the processing of notices and complaints submitted through the Services if you often submit clearly unfounded notices or complaints. Limiting Anagatas by PT. Anagata Arwana Indonesia License Rights. You have the option to restrict the Anagatas by PT. Anagata Arwana Indonesia Companies' use of your Content moving forward under this Agreement (as explained above) by choosing to grant the Anagatas by PT. Anagata Arwana Indonesia Companies has a more restricted license described further below (this more limited license will be referred to as a "Restricted License").
You can make this choice by selecting the Restricted License grant here (please note that you must be logged into your account to do so). If you decide to make this choice, the rights you provide to the Anagatas by PT. Anagata Arwana Indonesia Companies, regarding your Content according to the previously stated license terms (referred to as the "Standard License") will be limited in several key ways discussed in paragraphs 1 through 6 below; consequently, the Anagatas by PT. Anagata Arwana Indonesia Companies will not retain a Standard License for any of your Content other than the text-based reviews and associated bubble ratings you submit (for which the Anagatas by PT. Anagata Arwana Indonesia Companies will still be granted a Standard License), and will be given a "Restricted License" for the rest of your Content as defined below:
When you upload your Content to the Services, the license you give to the Anagatas by PT. Anagata Arwana Indonesia Companies for Your Content will be confined to a nonexclusive, royalty-free, transferable, sublicensable, and worldwide license to host, utilize, distribute, modify, execute, reproduce, display publicly, translate, and create derivative works from your Content for the purpose of showcasing it on the Services, as well as utilizing your name and/or trademark in association with that Content.
Subject to the Paragraph below, the Restricted License applies to any of your Content (again, excluding text-based reviews and associated bubble ratings) that you or someone acting on your behalf (e.g., a third party managing your account) share on or in relation to the Services. For any specific item of your Content that falls under the Restricted License, you can terminate the Anagatas by PT. Anagata Arwana Indonesia Companies' licensing rights for all of your Content covered by the Restricted License are forfeited by deleting your account (instructions for doing this can be found here). Regardless of any contrary statements, your Content
(a) will remain on the Services if you shared it with others who copied or stored it before you deleted it or terminated your account,
(b) may still be displayed on the Services for a reasonable duration after you delete it or terminate your account, while we work to remove it, and/or
(c) may be kept (but not displayed publicly) for technical, fraud moderation, regulatory, or legal reasons in backup form for a certain period of time.
Using our Services, which include setting up an Anagatas by PT. Anagata Arwana Indonesia account is at no cost, and payments are only processed when you make a reservation through the Services. When you make a reservation through the Anagatas by PT. Anagata Arwana Indonesia Companies, your payment details will be gathered and sent to the supplier to finalize the transaction, as outlined in our Privacy Policy. It is important to note that the supplier, not the Anagatas by PT. Anagata Arwana Indonesia Companies is in charge of processing your payment and completing your reservation.
The Anagatas by PT. Anagata Arwana Indonesia Companies will not arbitrarily interfere with reservations but maintain the right to withdraw booking facilitation services under certain exceptional circumstances, such as when a reservation is unavailable or when we have valid reasons to believe that a reservation request may be fraudulent. The Anagatas by PT. Anagata Arwana Indonesia Companies also reserve the right to verify your identity to process your reservation request.
Third-Party Suppliers.
The Anagatas by PT. Anagata Arwana Indonesia Companies are not travel agencies and do not own or provide transportation services, accommodations, restaurants, tours, activities, or experiences. While the Anagatas by PT. Anagata Arwana Indonesia Companies showcase information about properties owned by third-party suppliers and facilitate reservations with some suppliers through the Anagatas by PT. Anagata Arwana Indonesia Companies' websites, such actions do not imply, suggest, or establish any sponsorship or approval of third-party suppliers, nor any connection between the Anagatas by PT. Anagata Arwana Indonesia Companies and these suppliers.
While users may evaluate and review specific transportation services, accommodations, restaurants, tours, activities, or experiences based on their personal experiences, the Anagatas by PT. Anagata Arwana Indonesia Companies do not endorse or recommend the products or services of any third-party suppliers, except for certain awards based on user reviews that Anagata by PT. Anagata Arwana Indonesia may issue to businesses.
The Anagatas by PT. Anagata Arwana Indonesia Companies do not endorse any Content shared, submitted, or otherwise provided by any user or business, nor any opinion, recommendation, or advice expressed therein, and the Anagatas by PT. Anagata Arwana Indonesia Companies explicitly disclaim any and all liability associated with such Content. You acknowledge that the Anagatas by PT. Anagata Arwana Indonesia Companies are not liable for the accuracy or completeness of the information they receive from third-party suppliers and display on the Services.

For additional details, please consult the "Links to Third-Party Sites" section below. When booking travel services through the Anagatas by PT. Anagata Arwana Indonesia mobile app, some services are subject to an extra set of terms of use. These terms can be found within the app itself and are also accessible here. When making reservations for Holiday Rentals, restaurant bookings, and Experiences with third-party suppliers listed on corporate affiliate sites, certain corporate affiliates of Anagatas by PT. Anagata Arwana Indonesia functions as marketplace to assist travelers in:
(1) entering into agreements for holiday rentals with property owners and managers ("Holiday Rentals"),
(2) securing reservations at restaurants ("Restaurants"), and/or
(3) booking tours, activities, and attractions (collectively referred to as "Experiences") with third-party providers of such Experiences (with each supplier of a holiday rental and/or Experience referred to as an "Advertiser").
These corporate affiliates of Anagatas by PT. Anagata Arwana Indonesia distribute their advertisements to other entities within the Anagatas by PT. Anagata Arwana Indonesia Companies group, which is why they appear on the Anagatas by PT. Anagata Arwana Indonesia Companies' websites. As a user, you are responsible for your use of the Services (notably, the Anagatas by PT. Anagata Arwana Indonesia Companies' websites), along with any transaction related to Holiday Rentals, Restaurants, or Experiences facilitated by Anagatas by PT. Anagata Arwana Indonesia nor its corporate affiliates are involved in transactions for Holiday Rentals, restaurant reservations, or Experience-related agreements between travelers and Advertisers, any disagreements or issues arising from an actual or potential transaction between you and an Advertiser—including the quality, conditions, safety, or legality of a listed Holiday Rental, Restaurant, or Experience, the accuracy of the listing content, the Advertiser’s capability to lease a Holiday Rental property, provide you with a reservation, meal, or service at a Restaurant, or provide an Experience, and your ability to pay for a Holiday Rental property, a Restaurant meal or service, or an Experience—are entirely the responsibility of each user.
One of Anagatas by PT. Anagata Arwana Indonesia corporate affiliates may serve as a limited agent for an Advertiser solely to facilitate the transmission of your payment to them. You agree to pay the Advertiser, or a Anagatas by PT. Anagata Arwana Indonesia corporate affiliate acting as a limited payment collection agent on the Advertiser's behalf, any fees outlined to you prior to making a booking for any Holiday Rental or Experience, as well as any charges that may arise from damages resulting from your use of the Rental reservation or experience according to applicable terms or policies. For more details regarding fees for Holiday Rentals, security deposits, Experience fees, payment processing, refunds, and similar matters, please refer to the terms and conditions of our affiliates (visit Viator for Experiences, The Fork for Restaurants, and Anagatas by PT. Anagata Arwana Indonesia Companies' Holiday Rentals for holiday rentals). By making a reservation for a Holiday Rental, Restaurant, or Experience through one of our corporate affiliates, you will need to acknowledge and consent to their terms and conditions, along with their privacy policy. When you reserve international travel through third-party suppliers or plan international trips using the Services, you are responsible for ensuring that you fulfill all foreign entry requirements and that your travel documents, including passports and visas, are correct. For information about passport and visa specifications, please check with the appropriate embassy or consulate. Since requirements may change at any moment, ensure you verify the latest information prior to booking and departure. The Anagatas by PT. Anagata Arwana Indonesia Companies bear no responsibility for travelers who are denied entry onto a flight or into any country due to their own failure to carry necessary travel documents required by any airline, authority, or country, including those countries the traveler may simply be transiting through to reach their destination. It is also your responsibility to consult with your physician for the latest recommendations regarding vaccinations before you travel internationally and to ensure that you meet all health entry requirements while adhering to any medical advice related to your trip. While most travels, including to international destinations, occur without issues, certain destinations may pose higher risks than others. Anagatas by PT. Anagata Arwana Indonesia encourages travelers to research and assess travel bans, warnings, announcements, and advisories provided by both their own governments and those of their destination countries before booking international travel. ANAGATAS BY PT ANAGATA ARWANA INDONESIA MAKES NO CLAIMS OF ANY KIND REGARDING THE SUITABILITY OF THE SERVICES, INCLUDING THE INFORMATION DISPLAYED ON ITS WEBSITES OR ANY PART THEREOF, FOR ANY PURPOSE, AND THE INCLUSION OR OFFERING OF ANY PRODUCTS OR SERVICE OFFERINGS ON ITS WEBSITES OR OTHERWISE THROUGH THE SERVICES DOES NOT AMOUNT TO ANY ENDORSEMENT OR RECOMMENDATION OF SUCH PRODUCTS OR SERVICE OFFERINGS BY ANAGATAS BY PT ANAGATA ARWANA INDONESIA, REGARDLESS OF ANY AWARDS GIVEN BASED ON USER REVIEWS. ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, AND SERVICE OFFERINGS AVAILABLE BY OR THROUGH THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, ANAGATAS BY PT ANAGATA ARWANA INDONESIA DISCLAIMS ALL WARRANTIES, CONDITIONS, OR OTHER TERMS OF ANY KIND THAT THE SERVICES, ITS SERVERS, OR ANY DATA (INCLUDING E-MAIL) SENT FROM ANAGATAS BY PT ANAGATA ARWANA INDONESIA, ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANAGATAS BY PT ANAGATA ARWANA INDONESIA HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS REGARDING THIS INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OR TERMS OF ANY KIND RELATED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
THE ANAGATAS BY PT ANAGATA ARWANA INDONESIA COMPANIES SPECIFICALLY DISCLAIM ANY WARRANTIES, REPRESENTATIONS, OR OTHER TERMS OF ANY KIND REGARDING THE ACCURACY OR PROPRIETARY NATURE OF THE CONTENT ACCESSIBLE THROUGH THE SERVICES. THE THIRD-PARTY SUPPLIERS OFFERING ACCOMMODATIONS, FLIGHTS, RENTALS, EXPERIENCES, RESTAURANTS, OR CRUISE INFORMATION, AS WELL AS OTHER SERVICES ON OR THROUGH THE SERVICES, ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF THE ANAGATAS BY PT ANAGATA ARWANA INDONESIA COMPANIES. THE ANAGATAS BY PT ANAGATA ARWANA INDONESIA COMPANIES SHALL NOT BE HELD RESPONSIBLE FOR THE ACTIONS, MISTAKES, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES, OR NEGLIGENCE OF ANY SUCH SUPPLIERS NOR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR COSTS THAT MAY RESULT. Anagatas by ANAGATAS BY PT ANAGATA ARWANA INDONESIA ASSUMES NO RESPONSIBILITY AND WILL NOT ISSUE ANY REFUNDS IN CASE OF DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE, OR OTHER CIRCUMSTANCES BEYOND ITS IMMEDIATE CONTROL, AND IT HAS NO OBLIGATION FOR ANY ADDITIONAL COSTS, OMISSIONS, DELAYS, RE-ROUTING, OR ACTIONS BY ANY GOVERNMENT OR AUTHORITY. NOTWITHSTANDING THE ABOVE, YOU UTILIZE THE SERVICES AT YOUR OWN RISK, AND UNDER NO CIRCUMSTANCES SHALL THE ANAGATAS BY PT ANAGATA ARWANA INDONESIA COMPANIES (OR THEIR OFFICERS, DIRECTORS, AND/OR EMPLOYEES) BE HELD LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSSES OR DAMAGES, OR ANY LOSS OF INCOME, PROFITS, GOODWILL, DATA, CONTRACTS, MONEY UTILIZATION, OR LOSS OR DAMAGES ARISING FROM OR LINKED TO ANY TYPE OF BUSINESS INTERRUPTION CAUSED BY OR IN ANY WAY ASSOCIATED WITH YOUR ACCESS TO, DISPLAY OF, OR USE OF THE SERVICES OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY, OR USE THE SERVICES (INCLUDING, BUT NOT LIMITED TO, YOUR RELIANCE ON REVIEWS AND OPINIONS PRESENTED ON OR THROUGH THE SERVICES; ANY VIRUSES, BUGS, TROJAN HORSES, INFORMATION, SOFTWARE, LINKED SITES, PRODUCTS, AND SERVICES ACQUIRED THROUGH THE SERVICES (INCLUDING, BUT NOT LIMITED TO, ANY ANAGATAS BY PT ANAGATA ARWANA INDONESIA COMPANIES' SYNCHRONISATION PRODUCT); PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES' SERVERS AND/OR ANY PERSONAL AND/OR FINANCIAL INFORMATION STORED THEREIN; ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND SUSTAINED AS A RESULT OF USING ANY CONTENT; OR OTHERWISE ARISING FROM ACCESSING, DISPLAYING, OR USING THE SERVICES), REGARDLESS OF WHETHER BASED ON NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHER THEORIES, EVEN IF ANAGATAS BY PT ANAGATA ARWANA INDONESIA OR ITS CORPORATE AFFILIATES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
If the Anagatas by PT. Anagata Arwana Indonesia Companies are deemed responsible for any loss or damage that stems from or is related to your use of the Services, then their liability shall not exceed, in total, the higher of (a) the fees you paid to the Anagatas by PT. Anagata Arwana Indonesia Companies for the transaction(s) related to the claim, or (b) One-Hundred Dollars (US $100.00). The limitation of liability represents how risks are distributed between the parties involved. The limitations detailed in this section will remain in effect even if any limited remedy mentioned in these terms is found to be ineffective for its primary purpose. These limitations of liability benefit the Anagatas by PT. Anagata Arwana Indonesia Companies.
THIS AGREEMENT AND THE LIABILITY DISCLAIMER ABOVE DO NOT IMPACT MANDATORY LEGAL RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW, SUCH AS CONSUMER PROTECTION LAWS EXISTING IN SOME COUNTRIES. IN THE UK AND THE EU, THIS INCLUDES RESPONSIBILITY FOR DEATH OR PERSONAL INJURY DUE TO OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS, OR SUBCONTRACTORS, AS WELL AS FOR FRAUD OR FRAUDULENT MISREPRESENTATION.
If you are a consumer residing in the UK or the EU, this Agreement does not eliminate liability for losses and damages resulting from a failure to fulfill any duty to act with reasonable care and skill or from a breach of this Agreement, as long as the resulting damages were foreseeable at the time the obligations began.
IF THE LAWS OF YOUR RESIDENCE DO NOT PERMIT A SPECIFIC LIMITATION OR EXCLUSION OF LIABILITY ENACTED IN THIS CLAUSE, THAT LIMITATION WILL NOT BE APPLICABLE. THE LIABILITY DISCLAIMER WILL STILL BE ENFORCED TO THE FULLEST EXTENT ALLOWED BY YOUR LOCAL REGULATIONS.
INDEMNIFICATION
This section titled "Indemnification" does not pertain to consumers residing in the EU or the UK. You agree to defend and hold harmless the Anagatas by PT. Anagata Arwana Indonesia Companies and any of their officers, directors, employees, and agents from any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other expenses of any sort, including but not limited to reasonable legal and accounting fees, brought by third parties due to:
(i) your violation of this Agreement or any documents referenced herein;
(ii) your breach of any law or infringement on the rights of a third party; or
(iii) your utilization of the Services, including the Anagatas by PT. Anagata Arwana Indonesia Companies' websites.

The Services may contain links to websites that are managed by entities other than the Anagatas by PT. Anagata Arwana Indonesia Companies. These links are provided solely for your reference. The Anagatas by PT. Anagata Arwana Indonesia Companies do not oversee such websites and bear no responsibility for their content or the privacy and other practices of those sites. Moreover, it is your responsibility to take the necessary precautions to ensure that any links you click on or software you download (whether from this website or any other) is free from viruses, worms, trojan horses, flaws, and other potentially harmful items.
The Anagatas by PT. No software from the Services may be downloaded or exported/re-exported into, or to a citizen or resident of, Cuba, Iraq, Sudan, North Korea, Iran, Syria, or any other nation subject to U.S. embargoes, nor to any individual listed on the U.S. Treasury Department's Specially Designated Nationals list or the U.S. Commerce Department's Table of Deny Orders. Please be aware that the Software, including, but not limited to, all HTML, XML, Java code, and Active X controls contained in the Services, is owned or licensed by Anagatas by PT. Anagata Arwana Indonesia and is safeguarded by copyright laws and international treaty agreements. Any reproduction or redistribution of the Software is strictly prohibited and could lead to severe civil and criminal penalties. Offenders will be prosecuted to the fullest extent of the law. Some components of Anagatas by PT. Anagata Arwana Indonesia mobile software may utilize copyrighted materials, which Anagatas by PT. Anagata Arwana Indonesia acknowledges. WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCING THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR DISTRIBUTION IS STRICTLY PROHIBITED.
